The Main Points of the Patient’s Rights and Obligations Law

 

1.The right to receive medical treatment: Every person requiring medical treatment, is entitled to receive it, in accordance with the conditions and arrangements prevailing in the health system.

 2. Proper medical care: The patient shall receive medical care without discrimination on the grounds of religion, race, gender, nationality or sexual orientation. Every patient is entitled to receive professional, quality care and humane treatment.

 3. Treatment in an emergency situation: Treatment in the event of a medical emergency or serious danger shall be provided to the best ability of the practitioner or the medical institution and if necessary will include referral of the patient for treatment elsewhere.

 4. Informed Consent: The patient is entitled not to be given care unless he has given prior consent for this and after he received all information regarding the medical treatment. In certain cases, such as a medical emergency, circumstances under which the patient is unable to provide his consent, or other circumstances specified in the law, the practitioner is entitled to provide medical treatment even without the patient’s consent. Under exceptional circumstances, when a patient faces a serious risk and is opposed to receiving the urgent medical treatment he requires, the practitioner may provide care even contrary to the wishes of the patient. The patient may appoint a representative on his behalf who will be authorized to consent in his stead to receiving or preventing medical treatment, under circumstances and conditions that he instructs, in accordance with the Patient's Rights Law.

5. Second opinion: The patient is entitled, at his own initiative, to obtain a “second opinion” concerning his treatment and to receive the cooperation of the medical staff and the medical institution for this purpose.

 6. Maintaining the patient’s dignity: The patient is entitled to his dignity and privacy being maintained during all stages of the medical treatment.

 7. The right to receive information contained in the medical records: The patient is entitled to receive medical information from the records documenting his treatment. In certain instances, under circumstances where the provision of information may cause serious harm to the patient, the practitioner is entitled to refrain from providing that information. Receipt of the information entails payment for photocopying the medical documents.

8. Visitors: A patient hospitalized in a medical institution is entitled to receive visitors according to arrangements to be determined by the administration of that institution.

 9. Maintaining medical confidentiality: The patient is entitled to the maintenance of confidentiality of medical information relating to him. Medical information for further care may be shared among staff members, departments and health institutions, in accordance with the law.

 10. Identity of the practitioner: The patient is entitled to know the identity of the practitioner and his function.

11. Receive medical information: The patient is entitled to receive information on his condition from the attending physician during the normally accepted reception hours of the department.

 

Obligations of the Patient and the Visitor

 

The patient and his visitors are requested to comply with the rules of appropriate conduct within the confines of the hospital: v Provide the medical staff with full and detailed information on the patient’s condition. v Maintain silence. v Maintain the cleanliness throughout the hospital premises and the personal environment. v Refrain from smoking within departments and hospital buildings (except for the places marked for this purpose outdoors). Any patient found smoking in a smoking prohibited area is liable to a fine. v Refrain from damage to hospital property. This is an offense against the law! v Refrain from use of mobile telephones in the vicinity of medical equipment. v Refrain from bringing non-kosher food into the hospital.

 

2. Respect the visiting and rest hours: vThe patient is asked to notify his visitors regarding the department’s visiting hours. The presence of visitors in the department outside of hours disturbs the other patients’ rest and could interfere with and impair the work of the medical staff.

 3. The patient is requested to be tolerant and patient towards the practitioners and to behave politely and respectfully.

 4. The patient is requested to deposit personal belongings, including jewelry and money in the hospital safe. The hospital is not responsible for the loss of personal equipment that was not deposited properly.

 5. The patient is required to report to the staff his intention to leave the Department and the hospital premises.
